U.S. citizens can petition for parents, spouses, siblings, and children. There is no quota, or waiting list for “Immediate Relatives” of U.S. Citizens who are unmarried children under 21, Spouses, Parents, Widow / Widowers (under certain circumstances). Relatives in the following “preference” categories are subject to limits on the number of visas that can be issued each year.

Permanent Residents can petition for their spouses and children in the same way as a US citizen.

Victims of Crimes

Temporary nonimmigrant visas are available for victims of certain crimes, including:
? T visas for victims of human trafficking;
? U visas for victims of violent crimes (some common examples include domestic violence, involuntary servitude, kidnapping, false imprisonment, assault, blackmail, and extortion)

These visa categories allow a potential stay of three years and the ability to apply for legal permanent residence.

Victims of Domestic Violence
The Violence Against Women Act (VAWA) and the Battered Immigrant Women’s Protection Act of 2000 allow individuals who are married to U.S. citizens or lawful permanent residents to obtain residency in two ways: Self-Petitioning / Battered Spouse Petitions.

Victims of domestic violence can apply for residency independently of their U.S. citizen or lawful permanent resident spouses. The citizen or resident spouse plays no role in the process and is not allowed to know the applicant is filing a VAWA claim. VAWA is complicated, however, and I can represent you to attain legal permanent residency.

Cancellation of Removal is a form of relief available to applicants who are in, or who can be placed into, removal proceedings. Because applicants must be in removal proceedings before VAWA cancellation of removal is possible, my office will represent you against the government attorneys in front of a immigration judge. These court proceedings are confidential, so abusers will never know their victims are getting legal status.
